Ukraine: Sukha Balka to pay former worker UAH 300,000 in moral damages for occupational illness

On September 4, 2025, the plaintiff filed a lawsuit against PJSC “Sukha Balka” seeking compensation for moral damages caused by an occupational disease.

The plaintiff stated that she had worked for over 10 years (from October 14, 2013 to June 26, 2024) at the crushing and sorting plant of the Yuvileina mine as a conveyor operator and later as a screen operator. Prolonged exposure to hazardous working conditions, including excessive vibration and high concentrations of fibrogenic dust, led to the development of multiple occupational diseases, including stage II vibration disease, poly-radiculopathy, osteoarthritis, and chronic dust bronchitis with pulmonary insufficiency.

According to an investigation report dated April 10, 2025 and a medical conclusion, her illnesses were directly linked to unsafe working conditions at the Yuvileina mine, including violations of ventilation and dust suppression systems. On August 14, 2025, she was assigned a 65% permanent loss of professional working capacity and Group III disability.

As a result of her condition, the plaintiff experiences chronic pain, mobility limitations, breathing difficulties, fatigue, and psychological distress, significantly affecting her quality of life and ability to work.

The court ruled:

The claim is partially satisfied.

PJSC “Sukha Balka” shall pay the plaintiff UAH 300,000 in moral damages, without deduction of personal income tax.

PJSC “Sukha Balka” shall also pay court fees to the state in the amount of UAH 3,000.
