[Summary translation prepared by Business & Human Rights Centre]

Decision dated December 26, 2025, in case No. 212/13498/25

In November 2025, the plaintiff filed a lawsuit against PJSC “Sukha Balka” seeking UAH 400,000 in moral damages caused by loss of working capacity due to occupational diseases.

The plaintiff stated that he had worked in hazardous conditions at the defendant’s enterprise from July 20, 2007 to May 15, 2024 as an underground miner and tunneler and was dismissed due to health conditions preventing him from continuing this work. According to a decision of the expert commission dated November 4, 2025, he was assigned a 50% loss of professional working capacity.

The court established that the plaintiff worked underground at the “Yuvileina” mine and developed several chronic occupational diseases, including early-stage siderosilicosis with emphysema and pulmonary insufficiency, lumbosacral radiculopathy, and stage II vibration disease affecting the upper limbs and joints. These conditions were confirmed by an official occupational disease investigation report dated July 31, 2025.

According to employment records, the plaintiff’s total work experience amounted to 24 years and 5 months, including 16 years and 9 months under exposure to hazardous factors at the defendant’s enterprise.

The court ruled:

The claim is partially satisfied.

PJSC “Sukha Balka” shall pay the plaintiff UAH 270,000 in moral damages, without deduction of personal income tax.
